General Terms and Conditions Basecamp Eco-resorts
If you make a reservation at one of our Basecamp Eco-resorts via our website, by email, by phone, or otherwise, these terms and conditions apply.
APPLICATION
1.1 These General Terms and Conditions apply to all offers, reservations, and agreements regarding all accommodations and other facilities and services rented or provided by Basecamp Eco-resorts BV, its group companies, or affiliated enterprises (hereinafter referred to as ‘Basecamp Eco-resorts’).
1.2 In these General Terms and Conditions, the term ‘tenant’ refers to the person who enters into an agreement with Basecamp Eco-resorts concerning the rental/use of accommodation, facilities, and/or services. The term ‘user’ (also referred to as ‘guest’) refers to the tenant and the persons specified in advance by the tenant who will use the accommodation, other facilities, and/or services rented by the tenant.
1.3 These General Terms and Conditions apply regardless of your (prior) reference to any own terms or other general terms. Basecamp Eco-resorts rejects all general terms referred to or used by you.
1.4 Deviations from these General Terms and Conditions are only valid if agreed in writing.
RESERVATIONS
2.1 Basecamp Eco-resorts only processes reservations from persons who are 18 years or older. Reservations made by persons younger than this age are not valid.
2.2 Basecamp Eco-resorts reserves the right to refuse, without explanation, reservations that deviate, such as those from young people or groups, or to attach special conditions to them.
2.3 If Basecamp Eco-resorts accepts your reservation, it will send you a reservation confirmation and invoice within 24 hours of making the reservation. You must check the correctness immediately upon receipt. Any inaccuracies must be reported immediately to Basecamp Eco-resorts.
2.4 If you have not received a reservation confirmation/invoice within 24 hours after making the reservation, you must contact the reservation department immediately; otherwise, you cannot invoke the reservation.
2.5 An agreement is concluded between you and Basecamp Eco-resorts when Basecamp Eco-resorts confirms the reservation to you.
2.6 The agreement concerns the rental of accommodations and/or other facilities for recreational use, which is by nature short-term. The agreement can also involve the rental of accommodation and/or other facilities, possibly in combination with certain services provided by Basecamp Eco-resorts, for business use, which is by nature short-term, such as holding a business event.
2.7 The rental and/or right to use accommodation and/or other facilities ends automatically without any notification as soon as the agreed period for rental and/or use, as specified in the confirmation, ends.
CHANGES TO THE AGREEMENT
3.1 If, after the agreement has been concluded, you wish to make changes to the agreement, Basecamp Eco-resorts is not obligated to accept them. It is at the sole discretion of Basecamp Eco-resorts to determine whether and to what extent these changes are accepted. If Basecamp Eco-resorts accepts your changes, it will charge you modification fees. For cancellations, the cancellation conditions described in Article 14 of these General Terms and Conditions apply.
SUBSTITUTION
4.1 The tenant and other users are not allowed to transfer the accommodation to others, regardless of the name or reason, unless otherwise agreed in writing with Basecamp Eco-resorts.
4.2 If you and Basecamp Eco-resorts have agreed that you and/or one or more users will be replaced, you remain jointly and severally liable, along with the tenant and/or user(s) who replace you and/or other users, for the payment of the remaining rental amount, modification fees (see art. 3.1), any extra costs due to the substitution, damages, and any cancellation costs.
PRICES
5.1 You owe Basecamp Eco-resorts the agreed rental price, as stated in the reservation confirmation and invoice. To avoid misunderstandings: the ‘rental price’ may also include service costs by Basecamp Eco-resorts.
5.2 Discounts and/or special offers cannot be used once the reservation confirmation/invoice has been sent by Basecamp Eco-resorts.
5.3 All prices are, where applicable, inclusive of VAT unless otherwise stated.
5.4 Basecamp Eco-resorts has the right to implement and settle price increases resulting from interim adjustments of significant regulations (including, but not limited to, VAT, tourist tax, insurance tax) over which Basecamp Eco-resorts has no decisive influence.
5.5 The tenant is not entitled to offset any claim against Basecamp Eco-resorts with claims Basecamp Eco-resorts has against the tenant or to suspend any payment obligation.
PAYMENTS
7.1 When making a reservation, you can choose to pay the rental price immediately via iDeal or provide your credit card details.
7.2 If upon arrival at the park, it appears that the rental price has not been fully credited to the bank account of Basecamp Eco-resorts, you must pay (the remaining amount of) the rental price on the spot. If payment is not made accordingly, Basecamp Eco-resorts can deny you the use of the accommodation and/or other facilities. If it later turns out that a valid payment instruction had been given by you, but the amount was only credited to the bank account of Basecamp Eco-resorts after arrival, any overpaid amount will be refunded afterward.
7.3 If you fail to pay the invoiced amounts on time, you are in default immediately after the payment term specified in the invoice has expired. In this case, Basecamp Eco-resorts may offer you the opportunity to pay the outstanding amount within 7 days; otherwise, you are in default. If payment is not made, Basecamp Eco-resorts reserves the right to terminate (cancel) the agreement from the day the default occurs, and you are liable for all damages that Basecamp Eco-resorts suffers or will suffer as a result, including all costs incurred by Basecamp Eco-resorts in connection with your reservation and the termination, and any losses suffered by Basecamp Eco-resorts. Basecamp Eco-resorts is entitled to charge cancellation costs per accommodation. In this case, the provisions of Article 14 apply.
7.4 Basecamp Eco-resorts always has the right to offset any claims against you with amounts you have paid for any reason or with amounts Basecamp Eco-resorts may owe you.
ARRIVAL AND DEPARTURE
8.1 The rented accommodation can be occupied from 3:00 PM on the agreed arrival date as stated in the reservation confirmation. The accommodation must be vacated before 10:00 AM on the agreed departure date, as stated in the reservation confirmation, unless otherwise agreed in writing.
8.2 If you wish to extend the agreement with Basecamp Eco-resorts beyond the agreed duration and Basecamp Eco-resorts agrees in writing, Basecamp Eco-resorts is always entitled to assign a different accommodation.
8.3 If the use of the accommodation and/or other facility ends earlier than the agreed date, as stated in the reservation confirmation, the tenant is not entitled to a refund of (part of) the rental price and/or costs by Basecamp Eco-resorts. If you have taken out cancellation insurance and meet the conditions set by the insurance company, you can file a claim for compensation for the early termination of your stay directly with the insurance company.
REGULATIONS
9.1 All guests must adhere to the rules established by Basecamp Eco-resorts for the parks, set out in the Park Regulations. Park regulations may vary from park to park and are usually found on the relevant park’s website. The relevant Park Regulation can also be requested at the reception upon arrival. It is strictly prohibited for the tenant and users to act in violation of the law and/or public order and/or good morals on all parks. This includes drug use and causing noise nuisance.
9.2 According to local regulations, every guest is required to identify themselves at check-in (online). If a guest cannot show identification, Basecamp Eco-resorts may deny the guest the use of the accommodation and access to the park.
9.3 Each accommodation may only be used by the maximum number of persons specified in the brochure and on our website for the respective accommodation.
9.4 Basecamp Eco-resorts reserves the right to make changes to the layout and opening hours of the facilities of the parks. For necessary maintenance, you will allow work to be carried out on the accommodation or other facilities during your stay without entitlement to compensation.
9.5 For safety reasons, it is not allowed to place tents near the accommodation.
9.6 The tenant must leave the accommodation broom-clean (i.e., no dirty dishes left, bed linen removed and folded, kitchen and refrigerator cleaned, garbage bags placed in the designated container).
9.7 In case of violation of the rules included in these General Terms and Conditions, the Park Regulations, or failure to follow the staff’s instructions, Basecamp Eco-resorts has the right to remove you, the tenant, and any other user from the park immediately without refunding the rental price or part thereof.
9.8 If the park management suspects that a tenant or user of an accommodation is acting in violation of the law and/or public order and/or good morals, the park management is authorized to access the accommodation. Article 9.7 of these General Terms and Conditions applies in this case.
PETS
10.1 Depending on the accommodation, Basecamp Eco-resorts may allow a maximum of one dog belonging to the tenant or users. If you and/or a user wish to bring a dog, you must specify this at the time of booking. In this case, Basecamp Eco-resorts will charge a fee, which you must pay. Other pets are not allowed. Basecamp Eco-resorts reserves the right to refuse pets in the park (without giving reasons) or to deny them access to the park if they cause a nuisance.
10.2 Dogs are not allowed in water areas, restaurants, indoor center facilities, and other public areas in the park (unless otherwise indicated on-site). Dogs must be leashed outside the accommodation. On-site instructions must be followed. The dogs should not cause any nuisance to other guests.
10.3 Dog beds must be brought along, and flea protection is mandatory; drops, pills, or collars are sufficient.
10.4 Dogs and other pets of visitors are not allowed.
10.5 For the transport of animals to EU countries, they must have a passport according to the European model (from July 3, 2004). The animals must be vaccinated against rabies, and identification by means of a chip or tattoo is mandatory. You are responsible for having the correct travel documents required for your destination.
USE OF ACCOMMODATION; INVENTORY
11.1 The tenant and users and those accompanying the tenant are jointly and severally liable for orderly conduct in and around the rented accommodation and elsewhere in the park, the use of the accommodation and facilities, and the equipment therein.
11.2 Additionally, the tenant and user and those accompanying the tenant are always jointly and severally liable for damage due to breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be reported immediately by the tenant to Basecamp Eco-resorts and paid for immediately unless the tenant can prove that the damage was not due to the fault of themselves, other users, or a member of their group.
INTERNET USE
12.1 Depending on the accommodation, Basecamp Eco-resorts offers the tenant and user and those accompanying the tenant access to the internet via a Wifi network or cable.
12.2 The tenant is responsible for the correct use of the internet as well as the necessary hardware and software, configuration, peripherals, and connections to support this, and security measures for the computer and/or operating system.
12.3 Basecamp Eco-resorts is not liable for damage resulting from the use of the internet or network failures.
12.4 The tenant, users, and those accompanying the tenant must behave as responsible and careful internet users and respect essential rules when using the internet. The tenant and users will refrain from usage and behavior that hinders other internet users or causes damage to Basecamp Eco-resorts in the broadest sense. The tenant, users, and those accompanying the tenant will refrain from visiting internet websites with an unlawful nature and/or that do not align with the reputation of Basecamp Eco-resorts.
12.5 If third-party nuisance and/or (other) internet abuse by the tenant, users, or those accompanying the tenant is detected or suspected, Basecamp Eco-resorts has the right to block access to the internet without further notice, whether entirely or partially.
12.6 The tenant indemnifies Basecamp Eco-resorts against claims from third parties for damages that these third parties might (attempt to) claim from Basecamp Eco-resorts in any way, insofar as this claim is based on the internet use by the tenant, users, or those accompanying the tenant.
DEPOSIT
13.1 Basecamp Eco-resorts may require a deposit from you before or at the start of your stay. The deposit usually amounts to a minimum of € 100 per accommodation but may be increased by Basecamp Eco-resorts if circumstances warrant it (e.g., groups).
13.2 The deposit serves as a guarantee for damages and/or costs – in the broadest sense of the word – that Basecamp Eco-resorts may incur due to non-compliance with obligations by the tenant, user, and/or those accompanying the tenant.
13.3 If the deposit is not paid immediately when due, Basecamp Eco-resorts is entitled to deny the tenant and/or other users access to and use of the accommodation and facilities.
13.4 If you fail to pay the deposit, Basecamp Eco-resorts is also entitled to terminate the agreement with immediate effect (cancel), in which case the provisions of Article 14 apply.
13.5 The deposit or any remaining amount will be refunded after settlement of claims by Basecamp Eco-resorts against the tenant and/or users (e.g., due to damage to inventory/accommodation and/or other costs). Settlement of the deposit does not affect the right of Basecamp Eco-resorts to further claims for damages.
CANCELLATION COSTS
14.1 If a reservation is canceled, cancellation costs are due. The cancellation costs depend on the type of booking:
For Flexible Rate: cancellations can be made free of charge up to 2 days (48 hours) before the scheduled arrival. For later cancellations, 100% of the rental price will be charged. For Non-Refundable Rate: in the case of cancellation, 100% of the total rental price is always due. Cancellations must always be communicated to Basecamp Eco-resorts in writing.
14.2 You can insure yourself against cancellation risks by taking out cancellation insurance simultaneously with your reservation.
14.3 If you have not arrived at the park within 24 hours of the arrival date specified in the confirmation, this will be considered a cancellation unless you have notified Basecamp Eco-resorts in advance that you and your party will arrive later.
14.5 If after concluding an agreement for renting more than one accommodation, you wish to reduce the number of accommodations, 100% of the rental price is always due for cancellation unless other agreements have been explicitly made in the respective agreement.
FORCE MAJEURE AND AMENDMENT
15.1 If Basecamp Eco-resorts is unable to execute the agreement in whole or in part due to force majeure, Basecamp Eco-resorts may, within 14 days after becoming aware of the impossibility of performing the agreement, propose an amendment to you (for other accommodation/other period, etc.).
15.2 Force majeure on the part of Basecamp Eco-resorts exists if the performance of the agreement is wholly or partly, whether or not clearly foreseeable by you, prevented by circumstances beyond the control of Basecamp Eco-resorts, including but not limited to war risk, personnel strikes, blockades, fire, floods, and other disturbances or events.
TERMINATION
16.1 Basecamp Eco-resorts always has the right to terminate the agreement with immediate effect if at the time of reservation your or other users’ personal data are incomplete and/or incorrect. In such a case, no refund of the rental price or any part thereof will take place.
LIABILITY
17.1 Basecamp Eco-resorts is not liable for theft (including theft from safes or lockers), loss of or damage to property or persons of any kind during or as a result of a stay at one of our parks and/or the rental and use of accommodation and/or other facilities of Basecamp Eco-resorts, unless there is intent or gross negligence by Basecamp Eco-resorts or one of its employees.
17.2 Basecamp Eco-resorts is not liable for failures in the service or defects in services provided by third parties.
17.3 You and the user are jointly and severally liable for all loss and/or damage to the rented accommodation, facilities, and/or other property of Basecamp Eco-resorts caused during the use thereof by you and/or other users, regardless of whether this is due to the act or omission of yourself and/or third parties who are on the park with your permission.
17.4 You indemnify Basecamp Eco-resorts against all claims for damages by third parties resulting from any act or omission by yourself, other users, your travel companions, or third parties who are on the park with your permission.
17.5 In the case of incorrect use and/or incorrect leaving, including but not limited to excessive contamination, of the accommodation, additional costs will be charged, which you are then required to pay immediately.
COMPLAINTS
18.1 Despite the care and effort of Basecamp Eco-resorts, you may feel that you have a justified complaint regarding your holiday stay. This complaint must be reported to the management of the park of your stay immediately and on-site. If the complaint is not satisfactorily handled, you have the opportunity to submit your complaint in writing to:

mentioning reservation number, name and address details, date of stay, park name, and accommodation number. The complaint will then be handled with the utmost care. We will respond to your complaint within 3 working days.
If this does not lead to a satisfactory solution, you can also submit the complaint to the Disputes Committee via the European ODR Platform (https://ec.europa.eu/consumers/odr/). The decision of this committee has the force of a binding opinion. You can also submit your complaint to the competent court in Amsterdam according to the law.
APPLICABLE LAW
19.1 The agreement between you and Basecamp Eco-resorts and all related claims and disputes are exclusively governed by Dutch law.
19.2 The competent court in Amsterdam is authorized to take cognizance of all disputes arising from or related to the agreement between you and Basecamp Eco-resorts.
TRAVEL DOCUMENTS
20.1 You are responsible for having valid travel documents required for your destination. Basecamp Eco-resorts is not liable for the consequences arising from not having the correct travel documents.
PRIVACY
21.1 To make a reservation for one of our accommodations, we need personal data from you. We understand that you want to know what data we need, why we ask for this data, who will see your data, and how long we keep this data. Our privacy policy answers all these questions and more. The privacy policy can be found at www.basecamp-ecoresorts.com.
GENERAL
22.1 Basecamp Eco-resorts will send its correspondence digitally unless this is not possible.
22.2 Apparent printing and typographical errors do not bind Basecamp Eco-resorts.
22.3 With these General Terms and Conditions, all previous publications are void.
22.4 These General Terms and Conditions are available on the Basecamp Eco-resorts website in multiple languages. In case of ambiguities, the Dutch text of the general terms and conditions prevails.
